U.S. Navy Lieutenant wins battle against vaccine mandate
Lieutenant Moseley risked his twenty-two-year military career when, out of religious convictions, decided not to take the COVID vaccine despite it being mandated by the Department of Defense (DoD).
Mosely was charged with misconduct but chose to fight the charges with the assistance of attorney R. Davis Younts. Younts argued that the mandate was unlawful and therefore Moseley was within his rights to refuse.
The military is only allowed to mandate vaccinations that are FDA approved, and not merely authorized for emergency use. This was widely known and contributed to the FDA's decision to approve the COVID vaccines sooner than the original two-year waiting period.
After the FDA's approval, in August 2021 the DoD mandated that all military personnel be vaccinated using vaccines that are fully licensed by the FDA.
However, the DoD did not exclusively use the newly approved Pfizer vaccine, named Comirnaty, but also offered the original unapproved version of Pfizer's vaccine.
The DoD stated that the two vaccines can be used “interchangeably for the purpose of vaccinating Service members.”
This was the point that LT Bill Moseley used in his defense in front of the Navy's administrative board hearing. Specifically, the Navy mandate was unlawful since the vaccines they were providing were not FDA approved.
“Although this is only one case of thousands and we have many more clients facing prosecution by the military, we are encouraged that the truth was revealed in this Board, and we hope this ground-breaking case sends a strong message to the Department of Defense.” Younts said in a statement.
This distinction between using "authorized" vs "approved" COVID vaccines for the U.S. military was the subject of a letter from Sen. Ron Johnson to the Biden administration back in October 2021.
It remains unclear why the DoD is still offering unapproved COVID vaccines to military personnel despite it being a violation of the mandate and the military code.
Moseley's struggle is one that many servicemen and servicewomen continue to face, and one that America's Frontline Doctors (AFLDS) continues to champion.
In October 2021, AFLDS filed a preliminary injunction against the DoD in a federal district court to halt further mandatory vaccinations of military personnel. The human rights organization argued that not only is natural immunity scientifically proven to be superior to the vaccine, but the vaccine can actually be harmful. AFLDS brought multiple expert witnesses who testified to that end, revealing that both the Pfizer and Moderna vaccines contain toxins such as PEG (polyethylene glycol), ALC 3015 (Pfizer) or SM-102 (Moderna), which even according to the pharmaceutical companies are not safe for human use.
“People cannot believe that the manufacturers would knowingly put such a toxin into their product and test it on our entire population for the first time during these phase III clinical trials our country is participating in,” said Todd Callender, the attorney who brought the case.
AFLDS continues to advocate for medical freedom in the military and civilian sectors.
